Right of withdrawal clause (digital products)
Right of withdrawal
In accordance with the provisions of Directive 2011/83/EU on consumer rights, customers have a period of fourteen (14) days to exercise their right of withdrawal for any contract concluded at a distance.
Exception for digital content
However, Article 16(m) of the Directive provides that the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium (e.g. downloadable machine embroidery files) where:
- Performance has begun after prior express agreement of the consumer, and
- The latter acknowledged that he would thus lose his right of withdrawal.
